2. Services
Andes Talent provides specialized IT recruitment, remote staffing, headhunting, and related talent management services, connecting Latin American professionals with global companies.
Service scope, timelines, candidate guarantees, and deliverables are defined in specific written agreements or proposals.
Any changes to the scope of a recruitment search must be approved in writing.
Andes Talent reserves the right to refuse service or terminate engagement in accordance with these Terms.
3. Client Responsibilities
Clients agree to:
Provide accurate and complete information regarding job descriptions, technical requirements, and company culture.
Respond promptly to communications, candidate approvals, and interview feedback.
Ensure a safe and professional remote working environment for any talent hired through our platform.
Failure to provide required feedback may delay the recruitment process and candidate delivery.
4. Payment Terms
Fees for our recruitment services (whether placement fees or ongoing contractor management) will be clearly outlined in individual proposals or contracts.
Andes Talent may require upfront deposits (e.g., 50% retainer fee) to begin a specialized executive or technical search, as specified in the agreement.
Payments are due as specified in the invoice. Late payments may incur additional charges or suspension of candidate search services.
5. Confidentiality & Data Protection
Both parties agree to maintain strict confidentiality regarding sensitive information exchanged during the engagement. This includes business strategies, proprietary code/infrastructure details, and the personal data of the candidates.
Clients agree not to bypass Andes Talent to directly hire introduced candidates outside of the agreed contractual terms.
6. Limitation of Liability
Andes Talent thoroughly vets all candidates through psychological and technical assessments; however, the final hiring decision and employment liability rest entirely with the Client.
Andes Talent is not liable for any indirect, incidental, or consequential damages arising from the engagement of candidates or the use of our services.
7. Termination
Either party may terminate the recruitment agreement with written notice as specified in their individual contract.
Clients remain responsible for payment for services rendered or candidates successfully placed up to the termination date.
8. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of [Insert Jurisdiction, e.g., Mendoza, Argentina / Delaware, USA]. Any disputes arising shall be resolved in the applicable courts of this jurisdiction.
9. Changes to Terms
